FDA Announcements
FDA to regulate e-cigarettes as tobacco products
The FDA has issued a Letter to Stakeholders in which the agency announces that it will not appeal the recent decision in Sottera, Inc. v. FDA, and that the agency will comply with the regulatory guidelines for e-cigarettes that were set by the court. The letter states FDA’s intent to regulate electronic cigarettes as tobacco products, rather than placing the products under tighter regulations used for drug-delivery devices. While the court decision is seen as a victory for e-cigarette manufacturers and distributors, the FDA’s letter does state that e-cigarettes could still be regulated as drugs or drug-delivery devices if the devices are marketed as a smoking cessation aid or for another therapeutic use. FDA wants to get schooled in cigarette making, asks tobacco companies for learning tours
The FDA Center for Tobacco Products (CTP) is asking the tobacco industry to allow the agency to tour facilities that are involved in growing, processing, or manufacturing tobacco products. The FDA seeks to visit small and large cigarette factories, a smokeless tobacco plant, tobacco farms, a rolling paper factory, and a tobacco warehouse during the tours. The tours are not official inspections of the facilities, but are intended to help the CTP to better understand the industry and how it operates. Reynolds American Inc. has indicated that it will invite the FDA to its facilities, but Philip Morris USA has not yet responded. Read more here, or click here to see the notice from FDA with information for tobacco industry representatives interested in participating.
Draft Guidance: Establishing that a Tobacco Product was Commercially Marketed in the United States as of February 15, 2007
A new Draft Guidance document, Establishing that a Tobacco Product was Commercially Marketed in the United States as of February 15, 2007, was posted on the Federal Register and on CTP’s website on April 22nd. This document provides information on how a manufacturer may establish that its tobacco product was commercially marketed in the United States as of February 15, 2007. Eventually, tobacco companies will be required to either put products introduced after that date through an FDA review process or demonstrate that the newer products are equivalent to existing products. Click here to read the Draft Guidance for Industry and FDA Staff. A link to this document is also on the CTP website’s Substantial Equivalence page, which describes the process tobacco manufacturers will be required to undertake in order to bring a new tobacco product to the market.
FDA widgets available
The FDA Center for Tobacco Products (CTP) has made two widgets available to help stakeholders share FDA information easily. The “News You Can Use” and "Tobacco Retail Quiz" widgets can be copied and pasted into an organizational webpage, profile, or blog to automatically provide the latest news and updates from CTP. The retail quiz is available in both English and Spanish. Click here to see the widgets and learn how to place them on any webpage or blog.
