Cigar bar and other exemption application forms - 5/1/08

Q: The New Mexico Department of Health is seeking examples of cigar bar exemption application forms.  New Mexico's Tobacco Use Prevention and Control Program is developing regulations to help implement and enforce New Mexico's smoke-free law, including a narrowly-defined exemption for "cigar bars."
 
In addition, TTAC and the TCN are also interested in collecting other application or exemption forms that Health Departments have developed to implement smoke-free laws.  These forms will be made available as part of TTAC's Developing Smoke-Free Implementation Regulations project.  Please attach copies of relevant application or exemption forms if available.

A:

  1. Arkansas: In Arkansas, businesses use the Exemption Certification Form to apply for an exemption from the Arkansas Clean Indoor Air Law. The Environmental Health Protection reviews it and sends a letter to the applicant business communicating them whether they are allowed to be exempted or not from the Act. Enforcement is a complaining driven process. Arkansas’s Clean Indoor Air Act Rules are also available for viewing.
     
  2. Minnesota: Please see Minnesota's Tobacco Shop Fact Sheet or contact the tobacco program for more information.
     
  3. New Jersey: Go to www.smokefreenj.com for New Jersey’s statute.  There are several appendices that have the registration forms.  The State of New Jersey Application for Registration of Exemption for Cigar Bars or Cigar Lounges is also a resource.  Please note that one requirement for exemption is that the establishment had to have been in business before 12/31/06.
     
  4. West Virginia: Because West Virginia’s clean indoor air regulations are enabled by State Code to be done by local health departments, we do not have cigar bar exemption application forms.  We do address any store that primarily sells tobacco on a county by county regulation basis.
