Summary:
Most advocates for smoke-free air policies—whether in government, non-profits, or as individuals—are not lawyers. This webinar will help demystify potential legal pitfalls by reviewing the trends in legal challenges to smoke-free air laws. “Legal Authority to Regulate Smoking and Common Legal Threats and Challenges – 2009 Update,” by Cheryl Sbarra, an upcoming publication of the Tobacco Legal Consortium will be featured on the call. Stories from different states and localities will provide practical lessons on how to reduce the chances of encountering legal challenges and the tools available to minimize the effects of litigation.

Learning Objectives:
Participants will be able to
- Identify ways in which smoke-free laws have been challenged in the courts.
- Increase awareness of early vigilance and participation in drafting smoke-free legislation including participation in defining roles related to implementation and enforcement.
- Identify the opportunity to address gaps in legislation during rulemaking in ways to help avoid legal challenges, for instance, defining proprietors’ responsibilities.
- Recognize the value of working with partners throughout the process including lawyers and other stakeholders.
